1. ELIGIBILITY: Sierra Summer Car Count Down (the “Drawing”) is sponsored and operated by Sierra Autocars, Inc. (“Sponsor”). The Drawing is open only to legal residents of California over the age of 18 with a valid California drivers license. All employees, officer, directors and agents of Sponsor and Sponsor’s affiliates, including their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether related or not), are ineligible to participate in the Drawing. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Drawing constitutes your full and unconditional acceptance of these Official Rules. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. 2. DRAWING ENTRY PERIOD: The Drawing entry period begins at 8:00 a.m. May 1st, 2009 and ends at 9:00 p.m. on July 10th,2009. 3. DRAWING ENTRY INSTRUCTIONS: Each participating showroom at Sierra has one display vehicle with stuffed bears inside. Each display vehicles has the same number of bears inside. During the Entry Period, you may submit an entry at any one of the four showrooms. Guess how many bears are in the vehicle and enter the number on entry form.. A Sierra employee will assist you in filling out the entry form. Drop entry form into appropriate box provided. One entry per person. Entry forms must be filled out completely including valid phone number and e-mail address. Illegible entries that are drawn will be discarded and a replacement drawn. 4. SELECTION OF ENTRIES/ WINNERS/ODDS: The potential Grand Prize winner will be selected in a random drawing to be held on or about July 12th, 2009. The winner will be selected from entries received during the Entry Period. Odds of winning will depend on the number of eligible entries received during the Entry Period. The potential winner must be present at the time of the drawing and have the closest number count of Bears on the entry. All entries will be combined into one (1) drum for the drawing. Entries will be drawn at random two (2) entries will be drawn at approximately each half hour starting at 11:30 a.m. with the final drawing at 3:00 p.m. Sunday July 12th 2009. There will be a total of sixteen (16) entries drawn unless an entry does not meet the criteria. If a name drawn is not present at the time of the drawing another will be drawn to replace it until we have a contestant for that drawing period. Each name drawn will have (3) minutes to check in. After all the contestants have been drawn and added to the finalist board the actual winning number of Bears will be revealed. In the case of a tie the winner will be chosen by the order in which the names where drawn. The drawing will be conducted by the Sponsor, the judge of the drawing, whose decisions on all matters relating to the Drawing shall be final and binding. A log of winners will be available after the drawing is complete. 5. PRIZES: One (1) Grand Prize, a 2001 Oldsmobile Bravada, VIN serial # 12177237 with a total approximate retail value of $9,445.00 Sixteen (16) Second Prizes of Chevron $50.00 gas cards; Prizes will not be replaced if lost or stolen, are not transferable and are not redeemable for cash. Winner of car assumes responsibility for all license and registration fee’s, sales tax, income taxes and insurance. All expenses not specifically mentioned herein are not included as part of any Prize package, and are solely the winner’s responsibility, 6. GENERAL RULES: By entering or participating in the Drawing, participants agree to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Sponsor, including its affiliates and the employees, officers, directors, shareholders and agents of Sponsor and its affiliates (individually and together, the “Sierra Entities”) are not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the Drawing; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the drawing, the processing of entries, or the selection of winners. Further, if, for any reason, the drawing is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the drawing (or any portion thereof), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the drawing (or portion thereof). Sponsor also reserves the right at its sole discretion to disqualify the entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the drawing; (b) violating these Official Rules or the terms of service, conditions of use, and/or general rules of Sponsor; or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. The Sierra Entities are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize. 7.PARTICIPANT OBLIGATIONS: By participating in the Drawing, you agree to be bound by these Official Rules and the decisions of Sponsor. By accepting the prize, the winner agrees to release and hold the Sierra Entities harmless from and against any and all losses, damages, claims, actions and liabilities of any kind in connection with the Drawing or the receipt or redemption of the prize. The winner assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in the Drawing or use or redemption of any prize. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of California without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of California. 8. PERSONAL INFORMATION: The personal information collected through the drawing is subject to Sponsor’s privacy policy. By entering the Drawing, you agree to the use of your personal information as described in that Privacy Policy, which is posted at www.sierraauto.com.
